Terms & Conditions 

This Short-Term Rental Agreement ("Agreement") is entered into between the Guest and the Property Owner ("Host") for the temporary rental of the condominium located in Costa del Sol, Spain ("Property").

By confirming a reservation through our website, the Guest agrees to the following terms:

1. Booking and Payment

• Reservation Confirmation: A reservation is confirmed only upon receipt of full payment.

• Accepted Payment Methods: Credit card, bank transfer, or other methods as discussed with the Property Owner.

• Security Deposit: A refundable deposit of €200 is required. It will be returned within 7 business days after check-out, subject to inspection.

2. Cancellation Policy

• Free Cancellation: Available up to 30 days before check-in.

• Late Cancellation: Cancellations within 15-29 days of check-in incur a fee of 50% of the total booking.

• No Cancellation: Cancellations less than 15 days of check-in with no refund.

• No-Shows/Early Departures: Non-refundable.

3. Check-In / Check-Out

• Check-In Time: From 3:00 pm

• Check-Out Time: By 11:00 am

• Late Check-Out: Subject to availability and may incur additional charges.

4. Occupancy and Guest Conduct

• Maximum Occupancy: 4 persons. No unregistered guests permitted.

• Minimum Age: Guests must be 18 years or older to book and stay at the property.

• Verification: Valid government-issued ID may be required at check-in.

• Minors: Guests under 18 must be accompanied by a parent or legal guardian.

• Quiet Hours: 22:00 to 08:00

• Prohibited Activities: Parties, events, commercial use, or any activity that disturbs neighbors or violates community rules.

5. House Rules

• No smoking inside the Property.

• No pets unless explicitly authorized in writing.

• Use of common areas (e.g., pool, gym) must comply with condominium regulations.

• Guests must maintain cleanliness and respect the premises.

6. Damage and Liability

• Guests are liable for any damage caused during their stay.

• All furnishings, appliances, décor, linens, kitchenware, and other contents provided within the Property must remain in place and in their original condition throughout the rental period.

• No item may be removed, damaged, replaced, or disposed of by the Guest.

• Any loss, damage, or unauthorized relocation of items will result in deductions from the security deposit.

• Additional charges may apply to restore or replace missing or damaged items.

• The Host is not responsible for accidents, injuries, or loss of personal belongings.

7. Access and Security

• Guests will receive access details and parking information 48 hours prior to arrival

• Guests must ensure the Property is secured when unattended.

8. Legal Compliance

• Guests must comply with all applicable laws, including Spanish tourism regulations and local bylaws.

• Any illegal activity will result in immediate termination of the stay without refund and may be reported to authorities.

9. Termination of Agreement

• The Host reserves the right to terminate the stay without refund in case of breach of this Agreement.

• In such cases, Guests must vacate the Property immediately upon notice.

10. Governing Law and Jurisdiction

• This Agreement shall be governed by the laws of Spain.

• Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of Málaga Province.

• This contract is granted in accordance with the provisions of Spanish “Ley 29/1994, de Arrendamientos Urbanos”, and will be governed by what is freely agreed in its clauses, and in everything not included in it, by what is determined in Title III of the aforementioned law and by the provisions of the Spanish Civil Code. The parties submit by imperative of law to the Courts and Tribunals of the place where the property resides.

11. Acceptance

By submitting a reservation through our website, the Guest acknowledges and agrees to the terms outlined in this Agreement. A digital signature or checkbox confirmation shall constitute acceptance and be legally binding.
